It is an immigration benefit that in some cases can be requested outside the immigration courts but in many situations, is requested in front of an immigration judge. If approved, the immigrant will receive asylum status and after the first year passes, the immigrant may apply for legal residency in the United States.
It is obtained by filing the I-589 application in front of an immigration judge. Once the application is presented, the attorney’s written brief and the evidence, the prosecutor and the judge will review your request and then your request will be reviewed at a hearing or trial where the judge will determine whether or not the immigrant qualifies for the requested benefit.
Asylum may be granted to people who have been persecuted or fear they will be persecuted on account of:
- Membership of a particular social group
- Political opinion
